These Terms & Conditions govern your use of Estate49 (estate49.com), a division of Stenkepler Corporation (GSTIN: 29AEJFS5946L1Z5), registered at No.16/17/1, 72 G-006, Prabhavathi Divine, DR Rajkumar Road, Hulimavu, Bengaluru – 560076, Karnataka, India.
1. Acceptance of Terms
By accessing or using Estate49, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our platform. These terms apply to all users including property listers, seekers, and visitors.
2. About Estate49
Estate49 is an online real estate platform operated by Stenkepler Corporation that connects property owners, agents, and builders with potential buyers and renters across India. We provide tools for listing properties, searching listings, and facilitating introductions between parties.
Estate49 is a listing platform only. We do not act as a real estate agent, broker, or party to any property transaction.
3. User Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and truthful information during registration.
- One person may not maintain multiple accounts.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Listing Rules
When listing a property on Estate49, you agree that:
- All information provided is accurate, truthful, and not misleading.
- You are the legal owner, authorised agent, or have the right to list the property.
- Photos uploaded are genuine photos of the actual property being listed.
- You will not list the same property multiple times or create duplicate listings.
- You will not include contact details of competitors, spam links, or irrelevant content.
- All listings are subject to review and approval by the Estate49 admin team before going live.
- We reserve the right to reject or remove any listing that violates these rules without notice.
5. Paid Services
Estate49 offers the following paid services:
- Property Listing Fees: Charges for publishing property listings on the platform.
- Subscriptions: Monthly or annual plans providing enhanced listing visibility and features.
- Lead Packages: Packages providing access to verified buyer/renter leads.
- Advertisement Fees: Charges for promoted listings, banner ads, and featured placements.
All prices are in Indian Rupees (INR) and inclusive of applicable GST. Pricing is displayed at the time of purchase and may change with prior notice.
6. Payments
All payments are processed securely through Razorpay, a licensed payment aggregator. By making a payment, you agree to Razorpay's Terms of Service. Estate49 does not store your card, UPI, or banking credentials.
Payment confirmation will be sent to your registered email address. In case of payment failure, please contact us at support@estate49.com.
7. No Refund Policy
All payments made to Estate49 for listing fees, subscriptions, lead packages, and advertisement fees are strictly non-refundable.
- Once a payment is made and a service is activated, no refund will be issued under any circumstance.
- If a listing is removed due to a policy violation, no refund will be issued.
- If you upgrade, downgrade, or cancel a subscription, the remaining period will not be refunded.
- In the event of a technical error on our part causing double-charging, we will investigate and reverse the duplicate charge within 7 business days.

8. Prohibited Conduct
You must not:
- Post false, misleading, or fraudulent property listings
- Harass, threaten, or abuse other users
- Scrape, copy, or republish content from Estate49 without permission
- Use bots, scripts, or automated tools to access the platform
- Attempt to hack, disrupt, or compromise platform security
- Use Estate49 for money laundering or any illegal activity
- Impersonate another person or entity
Violation of these rules may result in immediate account termination and legal action.
9. Intellectual Property
All content on Estate49 — including the logo, design, code, and text — is the property of Stenkepler Corporation and protected under Indian copyright law. You may not reproduce, distribute, or create derivative works without explicit written permission.
By uploading photos or content to Estate49, you grant us a non-exclusive, royalty-free licence to display that content on the platform for the purpose of your listing.
10. Disclaimer of Warranties
Estate49 is provided "as is" without warranties of any kind. We do not guarantee:
- The accuracy or completeness of any listing information
- That any property shown is still available
- Uninterrupted or error-free access to the platform
- The conduct or reliability of any user on the platform
All property transactions are solely between the lister and the seeker. Estate49 is not a party to any transaction and accepts no liability for disputes arising from property deals.
11. Limitation of Liability
To the maximum extent permitted by Indian law, Stenkepler Corporation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Estate49, including but not limited to financial losses from property transactions.
12. Property Transaction Risks & User Responsibility
Estate49 is a listing platform only. We do not verify property ownership, legal title, or documents. All property information is provided by the listing owner and is solely their responsibility. Users must exercise due diligence before entering any property transaction:
- Document Verification: Always verify title deed, encumbrance certificate (EC), khata, and tax receipts
- RERA Compliance: Check RERA registration for all projects in your state's RERA portal
- Legal Counsel: Consult a qualified property lawyer before signing any agreement or making payment
- In-Person Visit: Never pay advance or deposit without physically visiting the property and verifying the owner's identity
- Payment Method: Use bank transfers only (NEFT/RTGS/cheque) — never pay in cash
- Registered Agreements: Insist on registered rent agreements or sale deeds
- Owner Identity: Match Aadhaar/PAN with property documents; verify Power of Attorney if dealing with an agent
Estate49 provides phone verification, admin review, and RERA badges as trust signals, but these do not constitute legal verification of ownership. Users transact entirely at their own risk. For disputes, approach the Consumer Disputes Redressal Forum or RERA Authority in your state.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
14. Changes to Terms
We may update these Terms at any time. Significant changes will be communicated via email to registered users. Continued use of the platform after changes constitutes acceptance of the updated terms.
